The BTVG applies if the buyer has to make payments of more than EUR 150\/m\u00b2 to the developer before completion; In this case, it is mandatory to appoint a trustee. The latter must strictly comply with the obligations imposed on him, which serve to protect the purchaser, in order not to be liable for any damages suffered by the purchaser.
