Short description

Private foundations are often in conflict with the compulsory share law, which is very strong in Austria compared to other countries. This may be because, unlike gifts to third parties who are not entitled to a compulsory share, when assets are transferred from a later testator to a private foundation, the separation of the assets from the testator is often less clear.
