Business succession

We advise and support our clients in (cross-generational) company succession just as competently and successfully as in connection with reorganizations. We take all aspects of the choice of legal form into account. Our client spectrum ranges from young entrepreneurs to internationally listed corporations, our consulting work from the establishment of a one-man GmbH to the planning and contractual structuring of complex – including international – restructuring measures with the involvement of private foundations and conscious use of tax advantages. HASCH UND PARTNER enjoys an excellent reputation in the area of company formation and succession, not least due to the ongoing lecturing activities of the firm’s lawyers.

  • Succession concept: We have developed and supported a large number of successful company successions. We are experienced in supporting and managing family discussions. The starting point is previous conceptual designs from a business perspective, which are then checked and discussed for feasibility in the family
    .
  • Inheritance law and compulsory portion law:In particular, compulsory share law often offers a certain area of tension with company values when developing a suitable sequence; We are experienced in setting up holding solutions that, by separating ownership and operations, also allow “departing heirs” who will not be operationally active in the future to participate with reduced influence for the purpose of paying off their compulsory share.
  • Expertise in reorganization law: Reorganizations are part of our special expertise, which helps us to design and achieve the most tax-efficient solution for you. This also applies to any related tax law.
  • management buy-in/buy-out; Employee participation: We often help to bind external management or employees to the company through investment solutions and know the right arrangements for this. This may also serve as an interim solution until a suitable family successor is available.
